March 5, 2026

Welcome – President Jason Robinson called the meeting to order and welcomed all attendees.

Self-Introductions –  23 people were present.

Meeting Minutes – February minutes were amended to change OUCC to OUNC under Publicity & Education. Modified minutes were approved at the opening of the meeting.

Treasurers Report – Naomi Shirtcliff: Invoices are being sent out for membership dues. Moved savings funds around to avoid fee on account. Budget summary review.

Publicity & Education– Byron Williams: The annual contractor’s breakfast will be held on May 7th at 0630. There is a strong desire to increase the swag on offer for the event and additional funding will be requested. The topic of the event is not settled but ideas were floated including giving the contractors a platform to vent their frustrations, followed by a strong presentation of what the LUCC is actively working on, with the motive to bring them back into the fold as participating members.

Damage Report– Jason Williams: Four damages to report this month. There has been some concern about locator performance recently, with a lack of documentation being cited as a major contributing factor. Highlight one incident involving Wildish and a “mark by measurement” locate. Jason notes that mark by measurement is never accurate, and NWN will always do an on-site standby to help when this is the case.

OUCC Standards Review – Rocky Stewart: Reading of the OUCC mission statement. The idea was also proposed to re-evaluate LUCC bylaws and possibly emulate some aspects of other councils that are desirable.

Old Business: Sentiment was expressed by an attending contractor that other contractors do not participate because there is a lack of power to change things. Another contractor pushed back, articulating the idea that you get out of it what you put into it. There was a general agreement that there should be more emphasis on the coordinating aspect of the council’s namesake.

It’s noted that the current environment for contractors is especially difficult, with one recounting locators in the cities of Sublimity and Lebanon showing up to a job site with witching sticks. Rocky offered to provide training resources for these cities.

Another point of emphasis during this discussion was contractors recouping expenses caused by bad locates. Rocky points out that the aggrieved party should be able to bill the locating company for these expenses. However, the effort to do so can be discouraging, especially in consideration of real damages vs. incurred damages, which would include the additional time and labor spent on the job after a bad locate.

New Business: The new TPAR manual is on the website and Byron notes this will become a big point of emphasis soon. Especially concerning are the audibles, which are expensive and frequently stolen.

Publicity & Education– Byron Williams: Locator workshop in Eugene coming up in December is being hosted by OUNC. Focus will be locate fundamentals, locate theory and equipment function. The class is 6hrs, and is $75/person. There are scholarship funds available. Link to the signup is on Luccdig.org, under News section. Limited to 12 people.

Damage Report– Jason Williams: Not Present.

Byron – 5 years ago there was a damage by a Zao contractor on Roosevelt Blvd, that went unknown until discovered this May. They drilled through a COE pipe at 11ft deep.

OUCC Standards Review – Jason Robinson: Related to the damage Byron mentioned: the rule to expose the drill head and back reamer through the tolerance zone was put in place in 2019, just prior to this work being done.

New Business: Byron: The city has a new TPAR tech within the engineering dept to help develop the TPAR program. The Utility group has also hired a TPAR inspector.

The city is working on developing a competent contractor course and requirements for working in the COE ROW. We are referencing CGA & PUC best practices as part of the research process.

Rocky Stewart has been elected as Vice President of the OUCC (Oregon Utility Coordinating Council). We are excited to have representation on the state board. Congrats, Rocky!

Kevin H – during open discussion: OUNC tends to focus on excavator safety and not put equal effort into operator / owner continuous improvement amendments.

COE Locator, responded to a locate ticket at University Park in Eugene. She found the contractor, D2, was digging fence post holes before the locate was due. The COE landscaper / Parks Dept staff was onsite overseeing the contractor and admitted they knew the dig laws were not being followed correctly.

Jason W: we need to utilize our permitting authorities to enforce dig laws. I’d like to see some tracking of repeat offenders and move to revoke permits and/or require trainings.

C2: would like to prose an industry-wide language change to transition away from the phrase “emergency” to “urgency” as it relates to utility response to minimize the environment / feeling that is inherent to the term emergency.

March 7th, 2024

Welcome – President Rocky Stewart called the meeting to order and welcomed all attendees.

Treasurers Report – Naomi Shirtcliff: 2024 invoices are going out. We reimbursed Jason $90.78 for 811 sign stakes. A budget summary report was provided.

Publicity & Education– Byron Williams: LUCC will be represented at the NWN Home show booth. We don’t need to have anyone work the booth. Q: Hunter signs are popping up around town, could we get the 811 logo added to their advertisements? – Jason Robinson will inquire with Hunter.  

Damage Report– Jason Williams: NWN had one damage last month by Pac-x. They had some concrete cave into the trench and hit a pipe fitting. Reynolds Electric & Plumbing had a cleared ticket but the locator missed understood the marking directions as needing both side of the building. Jason installed 10 new large banner signs around new subdivisions.

Web Page – Jessica Malmstedt: Not present. Amy: Jessica is working on updating the backlog of old meeting minutes, getting them added to the website. We are very grateful to have her take over the web page.

OUCC Standards Review – Jason Robinson: Pg 26, 1(a): “must mark within 24” w/ the Name, and width of facility”.

Old Business: none

New Business:  Rocky brought photos of a comm’s locate that didn’t have the facility owner’s logo & facility width labeled on a long stretch of located duct marks. They couldn’t identify the owner of the marks, nor how many conduits and/or size of conduits are to be expected in the trench. The rule (mentioned above) doesn’t specify how frequently the marks need to be labeled. 

Kevin H: The PUC has been looking into how this is being handled by operators and locators. CGA has a recommended marking practice. Some operators adopt their own requirements for their locators, others only go by the 811 rules (which is vague). Kevin also noted the positive response option will send an email when all responding operators have marked. This is a good reference tool to know who has marked facilities.

Ana /Wildish: Q: Why is there a discrepancy with pre-survey marks, engineered drawings, and dig ticket marks? A: There is a known issue with some locators not marking all of their facilities on a pre-survey, however they are supposed to mark everything. Engineered drawings can come from old survey’s that may have outdated information and/or original survey had missing data. We have seen dig tickets often show more facilities than shown during pre-survey marks.

Ana: Q: When a refresh ticket is called, are they required to remark? A: Yes, they are required to refresh all marks. Weather is always a challenge during the wet season. You can note the ticket to request alternative marking methods (flags, offset marks, meet on site, etc).

February 1st, 2024

Welcome – Vice President Jason Robinson called the meeting to order and welcomed all attendees.

Treasurers Report – Naomi Shirtcliff: Naomi provided a bank account overview: LUCC has an end of year balance of $738.15 in the checking account and $808.01 in the savings account, total of $1,546.16. We were charged a $5 service fee on the checking account because our balance dipped below $1,000. 2024 invoices for LUCC membership have gone out and should help bolster the checking account going into the next month.

Publicity & Education– Byron Williams: Byron reported that he met with Jim Franklin for a hand off of contacts and documents. He also spoke to Rocky about LUCC participating in the Eugene Home Show.

  • Because the spring home show falls on March 8-10 and the next LUCC meeting is on March 7th, there is some urgency to the decision-making.
  • Northwest Natural is willing to allow us to share a portion of their existing booth (a 10×10 booth is $1,125 so this is a substantial savings) and asks that volunteers wear their company branded gear while doing so.
  • Jason will send an email to officers about a planning lunch meeting ASAP.

Damage Report– Jason Williams: Jason discussed contacts with the following contractors:

  • Freedom Electric – received training
  • J A F Future, LLC – Damaged SUB infrastructure due to no or incomplete locates
  • Vannevel Concrete & Curb – Pounding in stakes directly over high-pressure gas line
  • Huckleberry Fence – received warning
  • Green Acres Landscape – received training

Jason also offered a hat tip to EWEB, for calling in while they were onsite and noticed unmarked NWN facilities.

Jason emphasized that all LUCC members have a responsibility to observe, contact, and report digging without locates called in, and a discussion ensued about potential means of recourse when one has no power to issue a stop work order. Calling the Oregon Public Utilities Commission was a recommended solution, as they have the ability to bring Oregon OSHA onsite and take enforcement action. There is also a standing offer of a $10 gift card for anybody who reports an excavator digging without a locate ticket to him.

Web Page– Amy Abramson: Jason Robinson shared an update on Amy’s behalf that Jessica Malmstedt of Williams has volunteered to maintain and update the LUCC web page. She was unanimously confirmed by a voice vote of LUCC members at the meeting.

OUCC Standards Review –Jason Robinson: Because the Damage Report led to a robust discussion about dig ticket requirements with regards to subcontractors working under another dig ticket, Jason briefly touched on page 24 of the OUNC standards manual that states that “the excavator must notify”, noting that excavator is defined on page 19 as “any person who engages in excavation” and leaves no exceptions for subcontractors to work under another ticket.

Old Business:

  • Jim Franklin of Lane County confirmed that he has seen an improvement in operators and excavators utilizing proper traffic control practices since he reported issues in January
  • Byron Williams of City of Eugene reported that he issued a stop work order to a Hunter Communications subcontractor for performing work without a traffic control plan.
  • Jason Williams has purchased new 811 sign posts and has filed for reimbursement with Naomi.

New Business:

Program:  Tyler Kirkpatrick of USIC

  • Introduced Wyatt Cornie, the new manager for the area including Lane County
  • Provided updates on their staffing:
    • 6 locators currently on staff (up from 3 in Summer 2023), with 5 more in training.
    • Tyler has shifted their statewide trainer to focus on skilling up locators in the Lane County area
  • Provided information on USIC’s workload and capacity in the area:
    • In Lane County, USIC is currently locating for: Lumen, Comcast, Douglas Fastnet, LS Networks, Ziply, and Charter
    • Eugene & Southern Oregon typically receives 170-180 tickets per day, and a fully trained locator is expected to complete 1.7 tickets per hour on average.
  • Shared suggestions for improved collaboration between excavators & USIC:
    • Would like to partner with operators and excavators to regularly discuss larger projects so they can keep staff at appropriate levels.
    • Expressed a willingness to have Wyatt come with numbers specific to Lane County, as well as damage reports.
    • Recommended calling either Wyatt or himself if a crew is onsite with a valid ticket and there are unmarked facilities present.

Jason Robinson expressed the LUCC’s gratitude for Tyler’s efforts to improve communication and collaboration, and Tyler offered to come to LUCC meetings quarterly, and for Wyatt to attend on a more regular basis.

Damage Report– Jason Williams: Sub was damaged by a drilling contractor. NWN had two damages, and EWEB knocked some coating off a pipe. Heath missed a locate and had another damage.

Jason had a handful of “no locate” conversations with folks.

Q: Should post replacements require locates? Yes, because a post hole digger is likely needed to clean out the hole, even if going back in same location.

COS shared they had a street light wire damaged by a drilling contractor and it had no locates.

OUCC Standards Review –Rocky: regarding last months damage due to two pipes running together but only one was marked, reminder to contractors as a best practice to expose beyond the facility, especially when its obvious you’re not in native soil.

Old Business: Jim Franklin: Lane County has had an increase in work in the ROW without proper traffic control. He has talked to the contractors as he comes across them and is surprised to receive non-compliant responses from them. Reminder that all work in the ROW is permitted and enforcement will take place if not in compliance with permit requirements, especially regarding matters of safety.

Roman: will not be able to provide Lumens damage reports.

New Business:  Jason W: ordered ten 4’x6’ signs from 811. We will need about $200 to purchase stakes hang them around town. Motion was made and passed to spend $200 for sign stakes. Naomi was not present to confirm the budget line item. We will follow up at the February meeting.

Treasurers Report – Naomi Shirtcliff: we issued the check to South Eugene HS, as of today it hasn’t cleared yet but it was received. Gift cards were purchased for give aways.

Publicity & Education– Jason R.: we are looking to fill this position. We’d like to acknowledge Jason Williams for receiving the Morrison Award. Congratulations, Jason!

Damage Report– Jason Williams: NWN had four damages last month. PacX damaged a couple lines on E 40th Ave due to failure to expose lines. Another damage on Echo Hollow occurred because the locator failed to mark that there was two pipes; the excavator exposed the one pipe that was marked, not aware of the second pipe. NE Roofing & Construction was digging without locates, EWEB reported this to Jason.

Jason reminds everyone to update tickets before they expire (45 day rule).

OUCC Standards Review –Jason Robinson / Jason W: this time of year, locate paint can wash away quickly in the rain. Ask for flags to be placed or to call if to wet to mark hard surfaces, this can be added as a note to the locate ticket. Its also a good reminder to keep up on your marks (maintain with white paint or capture in GPS).

Old Business: We haven’t received an update from Roman regarding the availability of Lumens damage reports.

SUB shared that Ziply’s contractor has improved their locate ticket requests and are using white paint.

New Business:  Question: NWN locate response used to include a link to pictures and map sketches of the locate, we haven’t been receiving them in a while. Jason W: we are aware, Heath has been working on getting this working.

The 2024 projects include approx. $20mil to transportation and another $10mil to parks.

Franklin Blvd received $30mil from federal funds to rebuild during the 2026-2027 year, engineering will begin in 2024.

Hunsaker will continue in partnership with Lane County.

W. 11th Ave, Charnelton to Garfield

Riverfront improvements continues.

Amazon creek concrete channel will be removed, and the creek will be “naturalized”.

Irwin Way pump station project just went out to bid.

Broadway surfacing project will begin in 2025, that includes removing the south lane to expand the sidewalk.

Reach out to Katie to discuss project planning communications. Reminder there are new ADA compliance requirements for worksite routing / pedestrian traffic control, per the DOJ.

Stan Petroff – City of Springfield

Franklin Blvd, Mississippi round-about

Sidewalk improvement project, “filling in the gaps” at various locations around Springfield and includes ADA ramps on Main Street.

Jasper trunk project to tie-in the new subdivision developments. This will mostly be on undeveloped land, so we don’t anticipate many utility conflicts.

Mill St, South A to Centennial Blvd, will include widening and a reconstruct.

South 42nd St and Daisy St will get a round-about.

Laura  Street concrete road project will continue

Treasurers Report – Naomi Shirtcliff: Sept & Oct budget summaries were provided. The PO Box fee has been paid.

Publicity & Education

Damage Report– Jason Williams: One shallow service damage. Jason is working with locators to notify NWN when they notice shallow lines during a locate.

New contractor working in the area called Fibertel had some issues with calling locates, Jason is working with them to provide education.

There was a handful of no-locate damages.

Web Page– Amy Abramson: Still looking to have someone take over this role.

OUCC Standards Review – Rocky: Recommends all operators register for Positive Response. This allows the ticket requester to see if a locate has been completed by the operator / locator.  This is especially helpful during the rainy season when marks wash away quickly.

Old Business: Jason W: brought in an email example of the notification being sent out by Lumen in response to nearly all locate tickets. The email notification states they have critical facilities in the area and advises not to dig until locate marks are completed. This feels like an attempt to meet the rule of “making contact”, allowing them to be late on the ticket. They have been doing this for a while and it feels like a work around to the rules. NWN is starting to charge for down time.

It was asked if Lumen experiences damages due to not locating on time. Roman (Lumen) replied to say they do have damages and often are called to make repairs. Q: can we get a copy of the damage stats? Roman: our damage reporting is national, and they don’t typically disperse regional reports. Rocky: can we request a copy? Roman is going to look into it.

South Eugene HS sponsorship – Amy proposed supporting tier 3 funds that includes one school year advertising via a banner on the football field, basketball court, and on their website. Motion was made and approved. We will also look into shifting our budget items around to make this an annual opportunity.

New Business:  RWD shared recent experiences with receiving large quantities of locate tickets in Springfield from a new contractor working for Ziply Fiber called Pets Group Logistics. They called in 49 tickets in one day in September. And several other since then. They aren’t using white paint to mark the locations and are referencing old SUB pole #’s that no longer are valid. A suggestion was made to close the ticket siting “unclear marking directions” if the location can not be determined by reading the ticket.

Jim F: you can also lean on the county with permitting, he will enforce where he can.

2024 Officer Nominations were made and approved. Jim F has stepped down from the Promo and Education chair, but otherwise all positions are nominating the same person as current. Voting will be held at December meeting.

Program:  Ed Fredette – COE Erosion Control Specialist – Erosion Best Practices

The city of Eugene maintains an MS4 permit with DEQ for all city sewer and storm facilities. Ed is tasked with enforcing compliance to meet the permit, specifically as it applies to construction conditions. COE has received three complaints from DEQ staff last month. DEQ has local staff and keeps an eye on construction around town. Our storm water goes straight to the river. COE has to report all contamination events to DEQ. “Runoff from construction is the primary contributor of impairment to water quality in the nation” -EPA

Ed focuses on education and on-site assistance to help excavators make a plan and meet requirements. A new concern is with rain gardens aka “vegetated facility”; if sediment fills over the planning soil it must be removed, and new soil & plants are replaced. This can be costly to a projects budget and time.

Remember to cover stockpiles. Pouring concrete in the rain will cause high PH discharge. Maintain and replaces biobags (or similar) often as they deteriorate or get damaged. There is an exception for emergency work but is no longer valid once responding personnel arrive onsite and are able to deploy containment measures. Crews should always have spill kits and inlet protection devices on their trucks for quick response to emergencies.

OUCC Standards Review –Jason Robinson: Emergency Locates – there is no definition for a required response time. Accepted Best Practice for our area has been 2 hours for many years.

NWN noted that if the emergency is for the gas company, its recommended to check-in with the responding crew lead for directions. Its not always safe to entire a site right away during a gas emergency, so delaying response might be acceptable but should be confirmed with the crew.

Old Business: USIC (Tyler – Supervisor) knows their response time for emergency tickets has been an issue; he is working on improvements. He has 10 potential new hires; trying to get them onboarded by Oct 16th. Current on-call staff has a large coverage area due to low staff levels. That should improve soon.

Program:  Kevin Bissel, Online Trainer – One Call Concepts (811 Call center)

The call center takes all in coming locate requests, online and by phone.

It has evolved from paper maps and exclusive phone operators, now with online ticket submissions.

Kevin is working on getting people to refine the work zone more specifically instead of “mark entire property”.

The system generated tickets will process out to the locators quicker because the “custom / hand written” ticket descriptions are manually reviewed by staff before it’s issued.

NWITIC@OCCINC.COM has a contact page to report issues such as “false emergency” tickets (i.e. fence installs, pools, etc.)

Updated mapping from utility operators is required to keep the 811 maps up to date. Each utility is responsible for sending changes and updates to their facility mapping.

Comment: The Radius tool isn’t capturing all of the utilities in the vicinity.

Response: This is typically due to outdated maps or changes in the utility operates name. That type of issue can be reported via the online chat.
